Dan Struck Receives Defense Verdict in Inmate Lawsuit

Following a two week trial in federal court, Dan Struck obtained a defense verdict on behalf of a correctional services provider. The six inmate plaintiffs were assaulted by a group of gang member inmates in a close custody unit. Plaintiffs alleged prison administrators failed to protect them, and that the prison had a custom and policy of understaffing the facility, which put inmates at risk of injury from assault. The plaintiffs claimed to have suffered permanent physical and emotional injuries and sought $600,000 in compensatory and $25 million in punitive damages.  The jury deliberated for approximately eight hours before returning a defense verdict.
